1. Acceptance of Terms

By engaging Construction Rx for services or using our website, you agree to be bound by these Terms of Service. Construction Rx is a DBA of Aqua Master Disaster Response Team, LLC, a Victory Formation Holdings company. If you do not agree to these terms, please do not use our services.

2. Description of Services

Construction Rx provides the following services to residential and commercial clients:

Residential & Commercial Painting: Interior and exterior painting, including walls, ceilings, trim, cabinets, and specialty finishes.
Drywall Repair & Installation: Drywall patching, hole repair, texture matching, and complete wall repairs.
Handyman Services: General home repairs, installations, maintenance, deck staining, and punch list items.

3. Service Area

We proudly serve Northeast Ohio, including Cuyahoga, Medina, Summit, Lorain, and Lake Counties. Service availability may vary by location. Please contact us to confirm service availability in your area.

4. Estimates and Pricing

Free Consultations: We provide free on-site consultations and detailed written estimates for all projects.

Estimate Validity: Written estimates are valid for 30 days from the date of issue unless otherwise specified.

Change Orders: Any changes to the original scope of work will be documented in a written change order, including any price adjustments, and must be approved by the client before work proceeds.

Price Adjustments: Prices may be adjusted if unforeseen conditions are discovered during the project (e.g., hidden water damage, structural issues).

5. Payment Terms

Secure Payments: All credit card transactions are processed securely through Stripe, an industry-leading payment processor with PCI-DSS Level 1 certification.

Payment Schedule: For projects over $1,000, a deposit of up to 50% may be required to schedule work. The balance is due upon satisfactory completion of the project.

Late Payments: Invoices are due upon receipt unless otherwise agreed in writing. Late payments may incur interest at the rate of 1.5% per month.

6. Warranty Information

Workmanship Warranty: We stand behind our work with a warranty on workmanship. Specific warranty terms vary by service type and will be provided in writing with your estimate.

Material Warranties: Manufacturer warranties apply to all materials used. We will provide documentation for material warranties upon request.

Warranty Claims: To make a warranty claim, contact us within the warranty period with a description of the issue. We will inspect and remedy any warranted defects at no additional cost.

Exclusions: Warranties do not cover damage caused by abuse, neglect, improper maintenance, acts of God, or unauthorized repairs or modifications.

7. Results Disclaimer

Individual Results May Vary: Project outcomes depend on many factors including existing surface conditions, environmental factors, material selections, and scope of work. Past project results do not guarantee identical outcomes for future projects.

Representative Photos: Photos displayed in our portfolio and marketing materials are representative examples of the types of projects we complete. Due to privacy laws and client confidentiality, specific project photos may not identify actual client properties without explicit consent.

Estimates and Assessments: All estimates are based on visible conditions at the time of inspection. Final pricing may be adjusted if unforeseen conditions are discovered during the project, such as hidden water damage, structural issues, or surface conditions not visible during initial assessment.

No Outcome Guarantees: While we are committed to delivering high-quality workmanship, we do not guarantee specific aesthetic outcomes, color matching to existing finishes, or results that depend on factors beyond our control.

8. Limitation of Liability

To the maximum extent permitted by Ohio law, Construction Rx and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services.

Our total liability for any claim arising out of our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

These limitations do not apply to damages resulting from our gross negligence or willful misconduct.

9. Dispute Resolution

Informal Resolution: We encourage you to contact us first to resolve any disputes informally. Most concerns can be resolved through direct communication.

Jurisdiction: Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Medina County, Ohio.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles.

10. Ohio Consumer Sales Practices Act Compliance

We comply with the Ohio Consumer Sales Practices Act (Ohio Revised Code Chapter 1345). You have the right to cancel a home solicitation sale within three business days under certain circumstances as provided by Ohio law. We do not engage in deceptive or unconscionable consumer sales practices.

11. FTC Compliance

We comply with all applicable Federal Trade Commission (FTC) regulations, including:

Truthful Advertising: All advertising claims are truthful, substantiated, and not misleading.
Clear Pricing: All material terms, including pricing, are clearly disclosed before any transaction.
Written Estimates: Detailed written estimates are provided before work begins.
